Welcome to Miday. These terms and conditions outline the rules and regulations for the use of Miday's Service. Please read them carefully before using the Service.

1. Definitions

• Service: The SaaS application provided by Miday, available in various plans including a free limited plan.
• User: Anyone who uses our Service.
• Subscription: A paid plan providing access to additional features of the Service, available on a monthly or yearly basis.

2. General Terms

• Eligibility: To use our Service, you must be at least 18 years old.
• Account: Users must create an account to use the Service, keeping their account information confidential.

3. Subscription

• Fees: Subscription fees are $3.99 per month or $35.88 per year. Users may also use a free limited version of the Service.
• Changes to Subscription: Users can upgrade, downgrade, or cancel their subscription at any time. Changes will be effective at the next billing cycle.
• Refunds: All purchases are final and non-refundable, except as required by law.

4. Intellectual Property

• Ownership: Miday retains ownership of all intellectual property rights in and to the Service.
• License: Miday grants users a limited, revocable, non-exclusive license to use the Service according to their subscription type.

5. User Responsibilities

• Content: Users are responsible for all content they upload or create while using the Service.

6. Limitation of Liability

• Cap: Miday's total liability for any claims arising out of the use of the Service is limited to the lesser of $100 or the total amount paid by the user in the 12 months preceding the claim.
• Indirect Damages: Miday is not liable for any indirect, incidental, or consequential damages arising out of the use of the Service.

7. Dispute Resolution

• Negotiation: In the event of a dispute, the parties agree to first attempt to resolve the issue through informal negotiations.
• Arbitration: If negotiations fail, the parties agree to resolve the dispute through arbitration.

• Notice: Miday reserves the right to change these terms and conditions at any time, with notice to users.
• Continued Use: Continued use of the Service after changes to the terms constitutes acceptance of the new terms.
